Terms of Service Agreement
PixelNayt’s Terms of Service
Updated on June 13, 2026Thank you very much for your interest to work with me! I implore you to read through the TOS before proceeding with your request. All Clients are required to read the Terms of Service before requesting.This Terms of Service Agreement (“TOS”, “Agreement”) shall be agreed upon by PixelNayt (“Artist”) and the commissioner (“Client”) for the service or commission (“Commission”, “Work”). By commissioning the Artist, the Client shall agree to the following terms:General Terms
1. All deliverables are digital and have no physical deliveries.
2. The Artist has the right to deny a Commission request if the subject matter of the request is uncomfortable to them or they cannot confidently complete the request. The Artist has the right to not delve into as to why.
3. Commission updates and communication will preferably occur through Discord or on channels such as VGen, Instagram and X (formerly known as Twitter) direct messages.
4. Please credit the Artist if you are using any art or design created by them!
5. Please do not claim the Artist’s work as your own.Materials Provision
1. The Client must provide clear Work requirements upfront prior to the Commission, including but not limited to reference materials and assets.Restrictions (Do’s and Dont’s)
1. The Artist will create content including but not limited to Fanart, OCs, Simple Animals, Creatures, or Mascots, Kemonomimi, and Ecchi works.
2. The Artist will not create content including but not limited to Detailed Backgrounds, Furry, NSFW / Explicit (Ecchi is okay), Fetishes, Mecha, Gore, Offensive, and Political work.Payment
1. The Client may pay in full upfront or half-upfront and then full upon completion.
2. Client will receive an invoice, proposal, or payment link when the Artist is ready to begin work. Payment must not be sent beforehand.
3. Payment must be made through PayPal, Vgen, or methods approved by the Artist.
4. Prices may vary depending on the complexity or requirements of the Commission.
5. The Client is to follow the Refund Policy and is warranted to not issue chargebacks.Refund Policy
1. The Client may cancel the commission if Work has not been started. A full refund will be issued by the Artist by the amount that the Commissioner provided upfront.
2. If the Artist has finished the sketch and the Client were to cancel the Commission, the Client is to receive a 70% partial refund and the artist will retain 30% of the upfront payment as labor fee.
3. For SKEB commissions, there is a strict no refund policy.
4. For artworks, the Client may request a refund if there are no updates or four weeks have passed since the completion of the sketch and the commission has no progress.
5. For VTuber Model Illustrations, the Client may request a full refund if the project hasn’t been started yet. A 70% Partial refund to the Client is available as long as the Artist has not entered the Line art, Render, or Cutting Phase. The Artist reserves the right to deny refunds once the aforementioned phases have been started.Work Process
1. The Artist will begin working on the sketch when payment is received either in full or in half upfront.
2. Once the Client’s Commission enters the Artist’s work queue, completion may take anywhere from 1 week to 7 weeks depending on complexity or Artist schedule. Any delay or disruption in the process will be communicated immediately. Kindly keep in mind that certain services such as VTuber Model commissions may be subject to longer periods.
3. Once the Artist finishes the sketch, the Client will receive the sketch for inspection to approve it or request revisions. When the sketch is approved, the Artist will move onto Lineart and Rendering.
4. When the Commission is completed, the Artist will send the deliverables to the Client’s provided email or through platforms such as VGEN or Google Drive after they paid in full.Revisions Guideline
1. The Client has 3 FREE Revisions before the Artist starts charging, the Client must kindly provide beforehand everything the Artist needs to know to avoid too much revision.
2. Revisions such as poses and details may only be done during the sketching phase. Once line art and rendering is started by the Artist, revisions will no longer be possible.
3. The Client acknowledges that Revisions may affect delivery time.
4. Revisions are free when:
> The artist failed to follow instructions or missed out on details the Client has provided.
> Small details need to be revised
> The Artist suggests an idea consulted with the Client.
5. Revisions are charged when:
> Big Changes (e.g. A completely new pose or composition to piece etc.)
> The Client wants to add extra details or add things that were not discussed initially.Use Policy
Please note that monetized and commercial prices may be different according to the type of commission. Some service listings may indicate different prices for commercial and monetized works and may have a set usages for the service in place.My commercial prices range around 50% to 100% of the commission price and may depend on what the Commission will be used for.1. “Personal Usage”. For Commissions that are personal, non-monetized, and non-commercial. (e.g. Social media posting, profile pictures)
2. “Monetized Usage”. For Commissions that are used to promote Client business including but not limited to monetized content (YouTube, Twitch, etc.), stream materials, branding (promos, banners, sponsorships, etc.)
3. “Commercial Usage”. For Commissions that will be commercially used in merchandising.
Digital Goods - VTuber Models, emotes, music video assets, etc.
Physical Goods - Keychains, prints, standees, etc.Commercial usage rights are not included immediately unless specified by the Commission type or the Artist’s service listing. The Client must provide clear information as to what Work Usage purpose the Commission is for upfront.Rights
1. The Artist has the right to cancel and refund the commission at any time within reason.
2. The Artist has the right to terminate the commission if the Client violates the terms of service (See Termination below).
3. The Artist retains all copyright to the commissioned Work unless a transfer of ownership has been made.
4. The Artist has the right to publish commissioned work online, in their own portfolio, and use the Commission for the promotion of the Artist’s own business, unless both Artist and Client discussed and agreed upon not to.
5. Client has the right to request reasonable status updates.
6.The Client may not modify, resell, or redistribute the commissioned Work without Artist consent.
7. Client may not edit or remove the Artist signature or watermark from a commissioned Work.
8. The Artist’s Works are prohibited from being fed into Artificial Intelligence (AI), Blockchain, or NFT Technologies.Termination
Violation of the Terms of Service by the Client, individual, or any third-party may lead to termination of the Commission. Potentially, severe violations may put the Client on the Artist’s Blacklist.1. If the client has become unresponsive or has become unreachable for no longer than 30 days without any reasoning or justification.
2. Any form of harassment, discrimination, or offensive acts toward any individual are grounds for termination.
3. Disclosure of any sensitive or confidential information to unauthorized parties are grounds for termination.
4. Feeding the Artist’s work through AI models, tools, machine-learning, blockchain, or NFTs and other for-profit platforms are grounds for termination.Privacy Policy
1. The Artist and Client acknowledges that information and materials of both parties (including but not limited to: personal information, payment information, business information) are classified as “Confidential” during the Commission process and shall not be disclosed to any unauthorized party or to the public.
2. Client can discuss with the Artist about NDAs or if the project is meant to be private. The Artist posts commissioned work on their SNS so please let the Artist know in advance if it is allowed or if they can post it after a set time (e.g. After a VTuber Model reveal, etc.)For any inquiries or questions about the Terms of Service, both Artist and Client may mutually discuss the situation.
